Legal email prospecting in France: what is permitted, or not
Writing to a company that doesn't know you is permitted in France, under certain conditions. Writing to an individual is much less so. This guide sets out the rules simply, from the difference between B2B and B2C to unsubscribing, and gives you a checklist to go through before each campaign.
- In B2B, no prior consent is required if the message concerns the recipient's profession.
- In B2C, prior consent is the rule, with an exception for your customers.
- Each email identifies the sender and offers a simple and free way to object.
- An objection is final: keep your list up to date.
- Collect only data useful for prospecting.
A plumber proposing his maintenance contracts to the building managers in his city, a web agency writing to restaurants in a neighborhood: email prospecting is a common and legal tool. It nevertheless obeys precise rules, set by the Code of Posts and Electronic Communications, in its article L34-5, by the GDPR and by the recommendations of the CNIL. It all depends first on one question: are you writing to a professional or to an individual?
IB2B or B2C: the distinction that changes everything
The starting rule of article L34-5 is prohibition: you do not prospect a natural person by email without their prior consent. But the CNIL admits a more flexible regime when writing to a person in the context of their professional activity, at their professional address, to discuss their profession with them.
The B2C exception concerns a specific situation: you collected the person's address on the occasion of a sale or service, you are proposing similar products or services that you yourself provide, and they were able to refuse at the time of collection. A winery writing to its customers to announce its new wine selection falls within this framework. Buying a file of individuals to write to them does not.
IIThe conditions for writing to a professional without their consent
The central condition for B2B prospecting: the message must relate to the professional activity of the person you're writing to.
Offering an accounting service to a bakery manager meets this condition. Offering them dog insurance at their professional address does not. The person's profession and the message subject must align.
Two other conditions apply. The person must be informed of the use of their data: where it comes from, who uses it and why, at the latest when you send the first message if you did not collect it from them. And they must be able to object simply and free of charge, in practice via an unsubscribe link that works.
IIIWhat every prospecting email must contain
The French Electronic Communications Code prohibits concealing the sender's identity and requires providing a valid way to request the cessation of messages. A correct prospecting email therefore contains few elements, but none must be missing.
Check what applies to you: the list remembers your answers on this device.
IVOpposition, minimization, retention: file discipline
A person who unsubscribes or replies "don't write to me anymore" must never receive your prospecting messages again. The right to object to prospecting is absolute. Maintain an up-to-date opposition list and check it before each send, including when you import a new file that might contain the same address.
For the rest, the rule is minimization: only collect what serves prospecting (name, position, company, professional address). No need to keep the birth date or personal profile of an executive. CNIL also recommends not keeping prospect data beyond three years after the last contact from them. Finally, the law does not set a number of follow-ups. I advise moderation: two or three messages without response, then stop.
VHow a prospecting agent applies these rules
An AI agent does not exempt you from the law. When properly configured, it helps apply it to each send, even on Friday evening. Here is the process for a well-constructed B2B prospecting campaign, as you can organize it with an agent like Milo, ABYS's prospecting agent.
- 1Target professionals
You define the targeted companies and the connection to their business. A patio furniture manufacturer targets restaurants and cafes, not individuals. The professional relevance is established from the start.
- 2Read the company's website
The agent reads each target's website to write a personalized email related to their actual business. The message is based on what the company publishes itself, without digging into the personal lives of its executives.
- 3Validate the first sends
You review the first emails before they go out: sender identity, subject line, unsubscribe link, message relevance. Nothing goes out without your approval at the beginning.
- 4Follow up with moderation
The agent follows up with prospects who have remained silent, according to the pace you have set, and respects objections and unsubscribes.
- 5Hand over to the human
As soon as a prospect responds, the agent stops and hands the conversation over to you. From that point on, the sales relationship is yours.
The agent follows the rules you give it, but the responsibility remains yours: you choose the targets and the content. This is a practical guide and not legal advice: for a specific case, or prospecting to another EU country whose rules may differ, consult a lawyer or CNIL resources.
Before a prospecting email campaign, which of these elements does the French Electronic Communications Code require?
?Questions we're asked
Is it legal to send prospecting emails without consent?
To a professional, yes, if the message relates to their profession, if they are informed about the use of their data, and if they can object simply and free of charge. To an individual, no in principle: you need their prior consent, unless they are already a customer and you're offering them similar products or services.
Does GDPR apply to B2B?
Yes, as soon as you process data about a natural person, even in a professional context: a first name, last name, an address like firstname.lastname@ are personal data. You need a legal basis, often legitimate interest in B2B, inform the person, respect their opposition, and limit collected data. Generic addresses like contact@ are not covered.
Can you buy an email file for prospecting?
In B2B, it is possible if the file was legally constituted, if the persons were informed that they could be contacted by partners and if you comply with the information and objection rules. Ask the seller for the origin of the data and the collection conditions. In B2C, a purchased file requires the consent of the persons to receive offers from partners.
Does Bloctel apply to emails?
No. Bloctel is the consumer telemarketing opposition list. It does not apply to emails. For emails, it's consent in B2C and the right to object, with the unsubscribe link, that protect people. Maintain your own opposition list and check it before each send.
