1. Purpose and Acceptance
These terms and conditions govern the use of the site abys.ai and its services, published by ABYS AI (Nice Business Register 524 019 031), hereinafter « ABYS ». Creating an account, using an agent or subscribing to an offer constitutes full and complete acceptance of these terms and conditions. ABYS may update them; the version in effect is the one published on this page at the date of use.
2. Service: AI agents—tools that serve people
ABYS provides artificial intelligence agents that are custom-configured based on the client’s description (the “need”), their answers to scoping questions, and the documents they provide. An agent performs defined tasks (reading, sorting, drafting, preparing, following up, and reminding) according to a plan presented to the client before any payment is made, and at a pace chosen by the client. Milo, Alfred, and Mila are in-house agents, presented as examples and starting points: each agent delivered is unique to the client who requested it.
An ABYS agent is a tool. It has no legal personality, no will of its own, and no authority to bind anyone. It acts solely within the framework established by the client, under the client’s supervision, and pauses before sending anything or making any commitment to seek the client’s approval, unless the client has expressly chosen to waive this requirement.
3. Responsibility: Oversight and decision-making remain in human hands
ABYS agents are tools designed to serve human clients. Everything an agent produces—whether it’s an email, a follow-up, a report, an application, a reminder, a file, or a figure—is a deliverable presented to the client, who reads it, corrects it, approves it, or rejects it.
The sole responsibility for a deliverable generated by an agent lies with the person who requested it and who ultimately delivers it. By approving a submission, forwarding a document prepared by an agent, or acting on the basis of information provided by an agent, the client alone assumes responsibility for the consequences with respect to third parties: recipients, clients, government agencies, employers, insurers, and family members.
The customer agrees to monitor his agent’s work: review its suggestions before approving them, verify the facts, amounts, dates, and recipients, and pause or stop the agent (with a single click in its interface) as soon as he no longer wants it to continue working. An agent left unattended works under the responsibility of the person who left them unattended.
ABYS is responsible for providing the service with professional care: reasonable platform availability, adherence to the presented plan, and compliance with the rules below. ABYS does not guarantee that the texts, analyses, or information produced by an agent are accurate, complete, timely, or suitable for a particular situation: artificial intelligence may make mistakes, misread a document, or misunderstand instructions. ABYS is not liable for decisions made by the client based on a deliverable, nor for the content of messages that the client has approved and sent, nor for indirect damages (loss of revenue, lost opportunities, loss of customers, or damage to reputation).
In any event, and except in cases of gross negligence or willful misconduct, ABYS’s liability to a customer is limited to the amount that the customer paid to ABYS during the twelve months preceding the event giving rise to the liability.
4. What an agent never does
Regardless of the instructions received, an ABYS agent:
- does not sign anything and does not bind anyone: contracts, powers of attorney, notices of termination, applications, and statements are prepared; the client is the one who signs and sends them;
- does not handle any money: no payments, no transfers, no access to bank accounts;
- does not provide any medical, legal, tax, or financial advice; it reads, files, recalls, and prepares information, and refers users to the appropriate professional;
- never addresses a minor;
- Do not send anything from an ABYS address: messages are sent from the client's address, on their behalf, after that address has been verified;
- never pretends to be human: it discloses that it is an artificial intelligence, in accordance with the European AI regulation.
5. The account
To use the agents, you must have an account, which can be created using an email address and password, or via a Google, Apple, or GitHub account. The customer is responsible for keeping their login credentials secure, is liable for any activity conducted through their account, and must notify ABYS immediately of any unauthorized use. ABYS never asks for passwords to the customer’s third-party services (email, software, banks): the agent works solely with the information provided by the customer.
6. Offers, Prices, and Payment
Prices are displayed excl. VAT on the Pricing page (VAT not applicable, article 293 B of the French Tax Code). Custom agents are offered in four monthly plans (19, 99, 199 and 349 euros excl. VAT per month) that set the frequency of work cycles and the number of messages per month. Milo (prospecting) and Milo + are separate monthly subscriptions (399 and 599 euros excl. VAT per month, 199 euros excl. VAT per month per additional prospecting department). The Premium Report (audit) is a one-time payment of 99 euros excl. VAT.
Payment is processed by Stripe. Subscriptions are non-binding: they can be canceled with a single click in the customer dashboard, effective at the end of the paid period. Any change to the frequency takes effect immediately. The agent’s plan is always presented before payment; the consultation, the plan, and any details are free of charge.
7. Right of Withdrawal (Consumers)
A customer acting in a personal capacity (for “home” use, family use, or private use) has a fourteen-day withdrawal period beginning on the date of subscription. When the customer chooses to have their agent begin work immediately, they expressly request that the service be performed before the end of this period and acknowledge that they forfeit their right of withdrawal for the portion of the service already performed. They may cancel their subscription at any time for future service.
A business customer is not subject to this time limit.
8. Data and Privacy
The information, responses, documents, and data entrusted to an agent are used solely for the purpose of performing work for the client. They are not resold, are not used to train a model, and are shared with third parties only to the extent necessary for the requested work (a confirmed message, an appointment request) or with ABYS’s contracted technical service providers (hosting, artificial intelligence models, payment). The client can delete their documents and data with a single click in their account; the agent does not retain anything that has been deleted.
Health or family documents entrusted to an agent (prescriptions, medical appointments, documents belonging to a loved one) are provided by the client at their own discretion, for their own reference; they are not processed for any other purpose. The customer has the rights provided for under the GDPR (access, rectification, erasure, objection, portability) and may exercise them by contacting contact@abys.ai.
9. Proven Structures and the Catalog
ABYS may offer a client, as a starting point, the structure of a paid agent who is active with another client (the agent’s steps and approach), but never the agent’s data, documents, or messages. A client who creates an agent agrees that its structure, in anonymized form, may serve as a starting point for others. The client may object to this upon request.
10. Ownership
The platform, its in-house agents, its text, images, and code are the property of ABYS. Deliverables produced by an agent for a client belong to that client, who assumes responsibility for them in accordance with Article 3.
11. Mediation and Governing Law
In the event of a dispute, an amicable resolution will be sought first: contact@abys.ai. A consumer may seek the assistance of a consumer mediator free of charge under the conditions set forth in the French Consumer Code. These terms and conditions are governed by French law; in the absence of an amicable agreement, the French courts shall have jurisdiction.
